1. Learned counsel for the petitioner would submit that on a one time settlement, the amount of Rs.10,14,357/- has been deposited, therefore the title deed of the mortgaged property may be returned to the petitioner who is 85 years old and has suffered from Hemorrhage.

2. Learned counsel for the respondent No. 2 would submit that after due verification of the fact, the title deed of the documents shall be returned to the petitioner.

3. In view of the said submission, the writ petition is disposed off with observation that the respondent No.2, after due verification, shall return the title deed of the mortgaged property to the petitioner within a period of 7 days from today.

4. The petitioner is at liberty to revive in case the cause of action arises in future, if any.
