2. Director, Women And Child Development Department, Directorate New Raipur, District Raipur, Chhattisgarh

3. Collector, Balodabazar, District Balodabazar Bhatapara, Chhattisgarh

4. District Program Officer, Women And Child Development Department, Balodabazar, District Balodabazar Bhatapara, Chhattisgarh ---- Respondents For Petitioner :

Mr. Sunil Sahu, Advocate For State :

Mr. Sudeep Verma, Dy. Govt. Advocate Hon'ble Shri Justice P. Sam Koshy Order On Board 20.01.2021

1. The grievance of the petitioner in the present writ petition is to the extent of non-extending the contractual services of the petitioner.

2. Perusal of the record would show that the substantive appointment of

the petitioner was on contractual basis which was periodically extended and lastly it was extended only for a period of one month and thereafter the services of the petitioner have not been extended.

3. Considering the fact that the substantive nature of appointment of the petitioner was that of a contractual employee, this Court does not find any indefeasible right created in favour of the petitioner for any appropriate writ to be issued to the respondents for taking the petitioner back as a contractual employee. The petitioner has already approached the concerned authority by making a representation which is still pending consideration before the authority.

4. Without expressing any opinion on the merits of the claim of the petitioner so far as the grant of further extension or re-engagement is concerned, the writ petition at this juncture stands disposed of directing the respondent no.3 to take an appropriate suitable decision in accordance with law.

5. The writ petition accordingly stands disposed of. Sd/- P. Sam Koshy Judge Khatai
