Perusal of the original record reveals that the accused appellant herein had preferred another criminal appeal being CRA No.982/2011, against the same judgement rendered in Sessions Trial i.e. 189/2009. Record further goes to show that CRA No.982/2011 has already been dismissed by this Court vide judgment dated 26/02/2015.

Since, the earlier appeal preferred by the same accused against the same judgment has already been dismissed, the present appeal preferred subsequently is not maintainable. Accordingly, it is dismissed.

Additional Registrar (Judicial) to conduct an enquiry on administrative side and submit the report in chamber categorically mentioning as to why the subsequent appeal preferred by the

accused appellant has been entertained particularly when the earlier appeal preferred by the same accused against the judgment passed in same Sessions Trial has already been dismissed on merits.
