This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.100/2016 registered at Police Station- Mandir Hasoud, Distt. Raipur (C.G.) for the offence punishable under Section 420, 465, 468 of Indian Penal Code.

Case of the prosecution, in brief, is that the applicant received an amount of Rs.5,35,000/- from Ashish Kumar Lahre to provide him job in the Mantralaya. Subsequently, the job could not be provided and as such as per the agreement, he has to return the amount but he failed to do so; thereby the offence has been committed. 3.

Learned counsel for the applicant would submit that infact the amount of Rs.50,000/- was paid to the father of the present applicant for some other transaction, however, the false allegations have been attributed to get back the amount against the present applicant; therefore, he may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the case diary, statement and the documents. Considering the facts and circumstances of the case and the way the offence has been committed and also the fact that the applicant has received an amount of Rs.5,35,000/- from the complainant, I am not inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed.
