Versus

1. Chhattisgarh State Power Distribution Company Limited Through The Chairman, Chhattisgarh State Power Companies Limited, Danganiya Raipur Chhattisgarh, District : Raipur, Chhattisgarh

2. The Chairman Cum Disciplinary Authority, Chhattisgarh State Power Companies Limited, Danganiya Raipur Chhattisgarh, District : Raipur, Chhattisgarh

3. The Executive Director (Hr), Chhattisgarh State Power Distribution Company Limited, Raipur Chhattisgarh., District : Raipur, Chhattisgarh

4. Shri S.P. Sharma (Enquiry Officer), Retired Managing Director, Chhattisgarh State Power Holding Company Limited, Through The Office Of The Executive Director(Hr), Chhattisgarh State Power Distribution Company Limited Raipur Chhattisgarh., District : Raipur, Chhattisgarh ---Respondents For Petitioner :

Mr. Rishi Rahul Soni, Advocate For State :

Mr. Anshuman Shrivastava, Panel Lawyer Hon'ble Shri Justice P. Sam Koshy Order on Board 02/09/2019 1.

The limited prayer of the petitioner is for an appropriate direction to the respondents to conclude the Departmental Enquiry initiated against the petitioner at the earliest.

2.

Counsel for the petitioner submits that the petitioner was served with a charge-sheet on 26.10.2015 and an Enquiry Officer was also appointed simultaneously. However, till date there has been no further development and the enquiry still stands in the same position as it stood four years back. Four years period is a very long time for a departmental enquiry to remain pending.

-23.

Given the aforesaid fact, this Court is of the opinion that no fruitful purpose would be served in keeping the petition pending, rather ends of justice would meet if the respondents No. 2, 3 & 4 take appropriate decisions and steps ensuring that the departmental enquiry initiated against the petitioner is concluded at the earliest preferably within a period of 6 months. 4.

The petitioner is also expected to render all necessary cooperation for the early conclusion of the enquiry.

5.

With the aforesaid observation, the writ petition accordingly stands disposed off.
