This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.69/2015, registered at Police StationSonhat, District-Korea (CG), for the offence punishable under Section 302 of the IPC and Sections 3 & 4 of the Tonhi Pratadana Adhiniyam. 2.

I have heard learned counsel appearing for the parties, taking into consideration the facts and circumstances of the case, nature and gravity of the offence, the manner in which the applicant is said to have pushed the deceased into well, by which, she died on account of drowning on 8.3.2015 and evidence available including testimony of eyewitness, this Court is of the opinion that present is not a fit case, in which, the applicant should be enlarged on regular bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is rejected.
