1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.43/2015, registered at Police Station Devendra Nagar, Raipur, Distt. Raipur, for the offence punishable under Sections 457 and 380 of the IPC.

2. Taking into consideration the nature and gravity of offence, facts and circumstances of the case, the manner in which the applicant is said to have stolen cellphone and Rs.36,000/- from the shop of Manoj Iswani on 18-4-2015 and consequent recovery, I am of the view that it is not a fit case to enlarge the applicant on regular bail. Consequently, the application is rejected. However, the trial Court is directed to expedite the trial and conclude the same as early as possible. Sd/- (Sanjay K. Agrawal) Judge Soma
