Considering the statement of PW-4 & PW-7, the leave to appeal is allowed.

Registry is directed to register the case as Acquittal Appeal. Since the Respondent has already represented, no further notice is required.

The Respondent is directed to furnish a bail bond of Rs.25,000/- before the trial Court within a period of one month so that his presence may be procured in this appeal before this Court as and when needed.
