Hon'ble Justice Shri Gautam Chourdiya Order on Board 28/01/2021 1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he is in custody since 04/09/2020 in connection with Crime No. 01/2020 registered at Police Station Amlipadar, District- Gariyaband (C.G.) for the offence punishable under Sections 294, 323, 506B & 307/34 of the Indian Penal Code.

2) Learned counsel for the applicant seeks to withdraw this bail application with liberty to file afresh application as and when occasion arises. Further he prays for return of certified copy of the impugned order.

3) Counsel for the State has no objection to the above prayer. 4) Permission granted.

5) Accordingly, the application is dismissed of as withdrawn with the liberty as stated above.

6) Registry is directed to return certified copy of the impugned order to the Counsel for the applicant on his furnishing true authenticated xerox of the same.
