This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.150/2015, registered at Police StationBhodghat, District-Bastar (CG), for the offence punishable under Sections 457, 380 and 411 read with Section 34 of the IPC.

I have heard learned counsel appearing for the parties and taking into consideration the facts & circumstances of the case, nature & gravity of the offence and the manner in which the applicant and co-accused persons are said to have stolen the property worth `8,09,380/- from the office of PHE, Jagdalpur on 1.6.2015, subsequent recovery of the stolen property from the applicant and considering his criminal record, this Court is of the opinion that present is not a fit case, in which, the applicant should be enlarged on regular bail. 3.
Accordingly, the bail application filed under Section 439 of the Cr.P.C. is rejected.
