This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No. 208/2015, registered at Police Station- City Kotwali, District - Dhamtari (C.G.) for the offence punishable under Section 420, 34 & 120B of Indian Penal Code (for short 'IPC').

Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in this case. None of the witnesses of the prosecution have made any direct allegation against the applicant in this case namely-Asha Gupta and Rajendra Gupta have been benefited with the grant of bail by this Court in M.Cr.C. No.6947 of 2016 and M.Cr.C. No.1624 of 2017 dated 30.1.2016 and 25.5.2017.
Page No.2 Applicant is in jail since 5.12.2015. Hence, prayed that applicant be enlarged on bail.

Learned counsel for the State/respondent opposes the bail application and submissions made in this respect.

Heard both the parties and perused the case diary. 5.
Considering the contents of diary and statement of the witnesses specifically the order dated 30.11.2016 in M.Cr.C. No.6947/2016 and order dated 25.5.2017 in M.Cr.C. No.1624 the connected matters in this case, hence, this appears to be a fit case where the applicant should be enlarged on bail.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
