The petition is against the order dated 08.09.2015 passed by the Judicial Magistrate First Class, Raipur, whereby, the application of the petitioner for surrendering before the Court has been rejected. 2.

Reading of the order would show that the learned Court below has refused the acceptance of surrendering of the petitioner, as he could not surrender himself physically before the Court.

Learned counsel for the petitioner submits that the petitioner is ready to surrender in person before the Court below.

Learned State counsel submits that in such case if the petitioner surrender himself before the Court, there will be no difficulty for the surrender. 5.

Consequently, it is directed that if the petitioner appears and present himself physically before the Court, the learned Court below shall take the surrender of the petitioner and shall proceeding accordingly. 6.
