2. The applicant has preferred this application for grant of bail as he is arrested on 25-1-2017 in connection with Crime No. 193/2016 registered in PS Arjunda, Distt. Balod (CG) for offence punishable under Section 420, 467, 468, 471 , 34 of the Indian Penal Code, 1860.

3. Learned counsel for the applicant submits that after investigation charge sheet has been filed and the same is pending before the JMFC, Gunderdehi, Distt. Balod as criminal case No. 698/2016. It is submitted that earlier the applicant had preferred MCRCA no. 912/2016 which was disposed of as withdrawn on 18-11-2016. Coaccused Hitesh Kumar Sahu also preferred MCRC No. 8272/2016 which was also disposed of as withdrawn by the coordinate bench on 22-12-2016. Thereafter again co-accused preferred MCRC No. 4046/2017 which was dismissed after consideration of entire merit vide order dated 22-6-2016. Learned counsel submits that the applicant is not directly involved in the offence, entire role in the alleged crime is attributed to co-accused Hitesh Kumar Sahu, hence he may be granted bail during trial as the trial may take some time.

He is in custody since long.

4. Per contra, learned State counsel opposes the bail application on the basis of evidence collected by police during investigation against the applicant.

5. Perused the matter.

6. On due consideration of entire facts surfaced in the charge sheet and the role assigned to the applicant in the charge sheet, looking to the severity of the offence, I am not inclined to grant bail. Consequently, instant MCRC is dismissed.
