The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.83/2016 registered in Police Station Basantpur, District Rajnandgaon (C.G.) for offence punishable under sections 379 of IPC.

As per the prosecution case, a report was made by one Yuvraj Sahu that he has parked his vehicle on 22/03/2016 which was stolen by some unknown person. Subsequently, applicant was arrested and on his memorandum, the vehicle said to be sold to Rajendra Sahu from whom vehicle was recovered.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, no allegation can be attributed against the applicant and only on suspicion he has been arrested, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Perused the case diary and memorandum of the applicant. Motorcycle was recovered from one Rajendra Sahu. Considering the
memorandum and the fact that similar nature of allegations have been attributed against this applicant, this court is not inclined to release the applicant on bail.
