The applicant has preferred this bail application as he has been arrested in connection with Crime No.127/2011, registered at Police Station Kunda, District Kabirdham (C.G.) for offence punishable under Section 34 (2) of the Chhattisgarh Excise Act. 2.

This second bail application under Section 439 of the Cr.P.C. has been preferred, because the earlier order granting bail stood cancelled on his failure to appear before the trial Court.

While releasing the petitioner on bail, this Court had observed that looking to his previous antecedents, the petitioner shall appear before the concerned Police at 11 a.m. every 1st Saturday of the month. Thus, it is apparent that the petitioner has previous antecedents and moreover he remained absent before the trial Court. 4.

For the foregoing, no case for entertaining this repeat bail application is made out. It is accordingly dismissed, however, the trial Court is directed to expedite the trial and make all possible endeavors to conclude the same, at the earliest.
