The grievance of the petitioners is to the inaction on the part of the respondent authorities in not taking a decision on their representation/objection made on 23.9.2021 (Annexure P1).

It is contended by the petitioners that the respondent authorities have issued the Gradation List pertaining to the Food Safety Officers wherein, one Sangharsh Kumar Mishra was placed at Sr. No.1, while Prashant Kumar Tiwari has been placed at Sr. No.12 illegally and despite of objection being raised in this regard on 23.9.2021, the concerned authorities have not decided the same till date. Learned counsel for the petitioners, therefore, prays for disposal of the said representation/objection within a stipulated period. 3.

Learned State counsel has raised no objection with regard to the aforesaid limited prayer of the Petitioners.

In view of the above, this Court feels that no useful purpose would be served in keeping the petition pending as the same can be disposed of at this stage itself.

Accordingly, the petition is disposed of by directing respondent No.2Controller, Food & Drug Administration Department, Raipur to take an appropriate decision on the said representation/objection made on 23.9.2021 within a period of three months from the date of communication/ receipt of the copy of this Order. 6.

It is made clear that this Court has not expressed any opinion on merits of the case while disposing of this petition and the concerned authority shall decide the said representations/objection in accordance with law. 7.

With the aforesaid observation, the Writ Petition stands disposed of at the admission stage itself.
