Admittedly, recovery proceedings are pending before the DRT, Jabalpur in respect of the subject loan, therefore, the writ petition is not maintainable, as two parallel proceedings cannot be permitted to be initiated. Even if the auction notice (Annexure-P2) is under the Securitisation and Reconstruction of Financial Assets and Enforcement of Securities Interest Act, 2002 (for short Act, 2002) and the rules framed thereunder, against the

said proceedings also, the petitioner has remedy of preferring an appeal under Section 17 of the Act, 2002 before the DRT, Jabalpur. The petitioner may do so even now.
