1. Learned counsel for the petitioner submits that the temporary bail was granted to him subject to the payment of clearing liability to the complainant. But petitioner is not able to comply with the terms of order granting bail and it is not enforced in time, therefore, the property held by the

petitioner's company be permitted to sold and proceeds thereof be paid to the complainant.

2. In view of that matter petitioner seeks permission of this Court to withdraw the present writ petition with liberty to move before the Competent Court for modification of condition(s) of order granting bail.

3. Accordingly, the present writ petition is dismissed as withdrawn with the aforesaid liberty remain in his favour.
