Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 29/03/2017 The petitioner has filed this petition aggrieved by order dated 25/04/2016 by which, the Trial Court issued permanent arrest warrant against the petitioner and the revision filed against the arrest warrant has been dismissed. 2.
Learned counsel for the petitioner submits that earlier, the petitioner had moved application for grant of anticipatory bail in the High Court of Madhya Pradesh in the year 1992 under MCrC No.778/1992 in which, there was an order passed by the High Court of Madhya Pradesh on 08/05/1992 staying the arrest. He submits that thereafter, the applicant presumed that anticipatory bail must have been granted to him because the petitioner was never communicated that his application was rejected. It is further submitted that the Courts below has issued permanent arrest warrant without service of warrant to the petitioner. 3.
It is found that way back in the year 1992, an interim order against arrest was passed. However, no material was placed before the Courts below or even before this Court to show that he was granted anticipatory bail later on. However, the order sheets of the Court below show that the petitioner has remained absent
and never appeared before the Court for the last seven years. Therefore, in these circumstances, no interference is called for by this Court. The petition is accordingly dismissed.
