The present MCC has been filed seeking modification of the order dated 28.08.2018 passed by this court in WPS No.5529 of 2018. The claim of the petitioner in the original petition was for promotion on the post of Teacher (Panchayat) w.e.f. the order when his juniors were promoted. The contention of the petitioner is that the petitioner has already got promotion and secondly his claim was for promotion from back date. While disposing of the petition, this court in paragraph 2 had mentioned the claim of the petitioner for promotion to the next higher post, which the petitioner has already got, however, the petitioner prayed the same from the back date. Therefore, the petitioner sough modification in the said paragraph 2 of the said order dated 28.08.2018 to the extent that he be granted promotion to the post of Teacher (Panchayat) with effect from the year, 2006.

The said prayer of the petition is not opposed by the State counsel. Accordingly, the order dated 28.08.2018 passed in WPS No.5529 of 2018 stands modified to the extent that in paragraph-2, after the words "Teacher (Panchayat)" the words "with effect from the year, 2006" is added and order

dated 28.08.2018 shall be read with the following modifications. With the aforesaid modification, the present MCC stands allowed. Let a copy of the order passed in this MCC be made part of the record of the original writ petition.
