The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.12/2017 registered in Police Station Sivrinarayan, District Janjgir-Champa (C.G.) for offence punishable under sections 363, 366-A and Section 17 of Protection of Children from Sexual Offences Act, 2012.

Case of the prosecution, in brief, is that report was lodged by the father of the victim that in between the intervening night of 28-29/02/2016 the applicant enticed away the minor girl from the lawful custody of the father on the pretext of marriage. Lastly he received phone call on 30/11/2016 by the girl from Delhi complaining that she was being abused and assaulted and subsequently her whereabouts were not known. 3.
Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, the applicant himself has lodged missing report on 17/12/2016 at New Delhi. He has not committed any offence, victim had herself has accompanied the company of the applicant and left the same, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Perused the case diary and the documents. Considering the statement of the father and the documents it appears that till date the victim is missing. Considering the same, this court is not inclined to release the applicant on bail.
