Challenge in this petition is to the order of transfer dated 14.08.2019 whereby the petitioner has been transferred from Industrial Health and Safety (Hygiene Laboratory), Raipur to the office of Deputy Director, Industrial Health and Safety, Korba.

The contention of petitioner is that the petitioner has got two sons and both the sons are suffering from Autism Spectrum Disorder (Autism) and they are under treatment at Raipur. He further submits that if at this juncture the petitioner is shifted from Raipur to Korba, it would be very difficult for him to manage.

Considering the aforesaid facts and circumstances of the case, let the petitioner make a representation to the respondent No.1 within a period of 10 day from today and the respondent No.1, in turn, shall consider the same and pass an appropriate order within a further period of 45 days. Till the representation of the petitioner is decided, the effect and operation of the order dated 14.08.2019 shall remain stayed. The respondents are

directed to consider the case of the petitioner sympathetically considering medical condition of both the children of the petitioner. 4.
