Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 03/03/2021

1. The applicant has preferred this bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.583/2019, registered at Police Station Mandir Hasaud, DistrictRaipur (C.G.) for the offence punishable under Section 20(B) of the Narcotics Drugs and Psychotropic Substances, Act, 1985.

2. Applicant was found in illicit possession of 4.5 Kilograms of contraband which he was carrying at the time of search.

3. Learned State counsel would oppose the prayer for grant of bail. However, he submits that concerned Station House Officer has not reported any previous antecedent or having committed similar nature of crime.

4. Considering the quantity of contraband recovered from the applicant and for the fact that he is in jail since 01-12-2019 i.e. more than one year and three months, I am inclined to release the applicant on bail.

5. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
