1. Present is the 4th bail application filed under Section 439 Cr.P.C. for grant of bail to the applicant, who has been arrested in connection with Crime No. 149/2017 registered at Police Station Gurur, District Balod, Chhattisgarh for the offence punishable under Sections 420, 467, 468, 471, 120B & 419 of the Indian Penal Code and Section 66(D) of I.T. Act. The earlier three bail applications stood rejected on 27.11.2017 in MCRC No. 5823/2017 and 06.08.2018 in MCRC No. 5643/2018 and 12.09.2018 in MCRC No. 6736/2018.

2. The State counsel on instructions submits that the complainant in the instant case has already been examined and is being subjected to cross-examination and the matter is now fixed for 24th of October, 2019.

3. Given the facts that the evidence has already started and more than half of the witnesses have been examined, it is not a fit case for releasing the applicant on bail at this juncture.

4. Considering the fact that this Court had already rejected the bail application on merits, not once but thrice, this Court does not find any strong case made out by the applicant for release on bail at this juncture, particularly when the evidences are in the midst of being recorded.

5. With the aforesaid observations, the present bail application stands rejected.
