Mus. Maanmati v. Sukhdeo Khairwar

HIGH COURT OF CHHATTISGARH, BILASPUR Order Sheet M. C. C. No. 662 of 2018 Mus. Maanmati and others Versus Sukhdeo Khairwar and others 18.09.2018 Shri Amiyakant Tiwari, counsel for the applicants. The present MCC has been filed seeking for modification of the order of this Court dated 23.01.2018 passed in MAC No.240/2011 to the extent that the appellants 3 & 4 in the said MAC have since expired. Though this Court had not made any apportionment in favour of the appellants 3 & 4, the present MCC has been filed only to bring on record the fact that the said two persons have since died and the appellants/applicants 1 & 2 are the legal representatives of the deceased.

Taking into consideration the factual matrix of the case, the impugned order dated 23.01.2018 passed in MAC No. 240/2011 stands modified to the extent that the appellants 3 & 4 would be considered as dead person and the compensation would be distributed by the concerned Tribunal to the legal heirs of the deceased. Let the order passed in the present MCC be made part of MAC No. 240/2011.
