1. This is the first bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court and no other bail application is pending before any other Court.
2. Perused the case diary provided by the learned counsel for the State in connection with Crime No.128/2019 registered at Police StationKabir Nagar, Raipur District- Raipur(C.G.) for the offence punishable under Sections 363(A), 370(A), 376 r/w 34 of Indian Penal Code and Section 4, 17 of Protection of Children from Sexual Offences Act and Section 3 Prevention of Immoral Traffic Act.
3. Case of the prosecution, in brief is that co-accused Mukku Verma was trapping the girls in love affair. Co-accused Mukku Verma, Asha Verma, Payal Sahu, Smt. Gouri Yadav and applicant were operating the sex racket. The said co-accused used to get wrong work from the girls.
4. Learned counsel for the applicant submits that applicant is 65 years old lady, her health is not well, she has been falsely implicated in the present case, she was the servant of Varsha Sahu. Thus, she may be released on bail.
5. On the other hand, learned counsel for the State opposes the bail application, however, submits that there is no criminal antecedent against the applicant in police case diary.
6. Looking to the above mentioned facts and circumstances of the case, looking to the material available on record against the applicant, looking to the seriousness of the offence, looking to the impact of granting bail to the applicant on society, the present bail application is rejected.
