1. The instant petition is against the order dated 9.2.2017 passed in Complaint Case No.353/2017 by which the Judicial Magistrate First Class, Raipur, has taken cognizance against the petitioner for trial of offence under Section 138 of Negotiable Instruments Act.

2. Learned counsel for the petitioner submits that in the similar matter bearing Cr.M.P. No.808 of 2017 the petition was dismissed with liberty that the petitioner may avail the remedy to approach to the Sessions Court in revisional jurisdiction and be allowed to withdraw this petition to file a revision petition.

3. Considering the same, the petition is dismissed as withdrawn with the aforesaid liberty to approach to the concerned Court having revisional jurisdiction. Sd/- (Goutam Bhaduri) JUDGE Nisha
