1. Challenge in the present Writ Petition is to the order dated 19.08.2019 whereby the petitioner has been transferred from Primary Health Centre, Devri, Janjgir Champa to Primary Health Centre, Bhaiswar, Koriya.
2. The contention of the petitioner is that, the wife of the petitioner is also a government servant and is also posted at the same place where the petitioner is presently posted. He further submits that on the ground that wife was posted here, the petitioner has been brought at the present place in the past and is now being sent to far a place again disturbing the family life of the petitioner. The petitioner refers to clause of the transfer policy which shows that as far as possible the Husband and Wife should be accommodated at the same place.
3. Given the aforesaid facts, let the petitioner make a detailed representation in this regard to the respondent No.1 within a period of 10 day from today,
and the respondent No.1, in turn, shall consider and decide the same at the earliest preferably within a further period of 45 days. Till the representation of the petitioner is decided, the effect and operation of the impugned order dated 19.08.2019 so far as petitioner is concerned, shall remain stayed.
