The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.243/2016 registered in Police Station Sarangarh, District Raigarh (C.G.) for offence punishable under section 4 (B) & 5 of Explosive Substance Act. 2.
As per the prosecution case, on a raid being conducted on 13/06/2016 in the Crusher Mines, 194 numbers of explosives were recovered from the possession of the present applicant. 3.
Learned counsel for the applicant submits that according to the seizure, the alleged recovery was made from the land of one Parikshit Sidar though the seizure is said to have been made from the present applicant. He submits that no further investigation is necessary in this case as the charge sheet has been filed and therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Perused the case diary and the document and also considered the statement of Parikshit Sidar wherein it is stated that the land wherefrom the recovery was made was given on lease to Baratu. Further considering
the fact that charge sheet has been filed, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
