For the reasons stated in the application as also the fact that no reply has been filed till date, the delay of 59 days in filing the Cr.M.P, is condoned.

Heard on application for grant of leave to appeal. On due consideration, application for grant of leave to appeal is allowed.

Registry is directed to register the case as an acquittal appeal.

Respondent is directed to furnish bail bond of Rs.25,000/-

and surety in the like sum before the learned court below within a period of one month so as to secure his presence before this court as and when needed.
