Since all the bail applications (two 438 & one 439) are arising out of same crime number i.e. Cr.No.111/2020 they are being considered and decided by this common order.

The applicants have preferred these bail applications for grant of anticipatory bail, as they apprehend their arrest in connection with Crime No.111/2020, registered at Police Station Kunda, District Kabirdham (CG), for offence punishable under Sections 363, 366, 376 (2) (n) of the Indian Penal Code and Sections 4, 6 (ढ) of the Protection of Children from Sexual Offences Act, 2012.

The applicant has preferred this bail application under Section 439 of CrPC, as he is arrested in connection with crime No.111/2020 registered at Police Station Kunda, District Kabirdham (CG), for offence punishable under Sections 363, 366, 376 (2) (n) of the Indian Penal Code and Sections 4, 6 (ढ) of the Protection of Children from Sexual Offences Act, 2012.

Applicant Ravi Kumar developed an affair and thereafter committed sexual intercourse with the prosecutrix, aged less than 18 years, on promise to marry. Co-accused Byasnarayan @ Golu Mohle & Jaleshwar were also involved in gaging and abducting the prosecutrix on a motorcycle.

Considering the nature of crime and particularly considering the age of the prosecutrix, this Court is not inclined to release the applicants either on anticipatory bail or on regular bail. 6.

As a result, all the bail applications (two 438 & one 439) are rejected.
