1. The challenge in the present Writ Petition is to the order Annexure P1 dated 22.08.2019, whereby the petitioner has been transferred from Government District Hospital, Mungeli to Civil Hospital, Pankhajpur, Kanker, (C.G.)

2. The contention of the petitioner is that, the wife of the petitioner is also a Government Employee and was posted at Raipur. The wife of the petitioner made a request for being transferred at the place, where the present petitioner was posted ie., at District: Mungeli. The request of her wife was acceded and an order was passed on 13.08.2019, whereby the wife of the petitioner is ordered to be posted at Mungeli and she was also relieved from Raipur and also joined at the transferred place ie., Mungeli.

-23. However, contrary to the transfer policy, the husband now has been transferred to a different direction vide the impugned order.

4. Given the aforesaid facts and circumstances of the case, particularly taking into consideration, the transfer policy particularly the clause pertaining to husband and wife to be posted at the same place as far as possible.

5. Let the petitioner make a detailed representation to the respondent within a period of 10 days from the date of receipt of copy of this order and the respondent shall consider the same within a period of further 45 days from the date of receipt of representation of the petitioner.

6. Till the representation of the petitioner is decided, there shall be stay of the effect and operation of the impugned order (Annexure P-1), so far as the petitioner is concerned.
