Annexure-P-1 was passed cancelling some works sanctioned for the Gram Panchayat, Getra, Janpad Panchayat, Lakhanpur, District Sarguja. Therefore, it is the Gram Panchayat who can maintain a petition and not the Sarpanch in his individual capacity.

At this stage, learned counsel for the petitioner would seek permission of the Court to withdraw the writ petition with liberty to prefer a duly constituted writ petition on behalf of the Gram Panchayat.

Accordingly, the writ petition is dismissed as withdrawn with the aforesaid liberty.
