Hon'ble Shri Justice P. Sam Koshy Order on Board 30/08/2019 1.

The challenge in the present writ petition is to the order Annexure P/1 dated 31.07.2019, whereby the petitioner has been transferred from Govt. Higher Secondary School, Turtha, Narayanpur, District Narayanpur to Govt. Higher Secondary School, Gudadi, Block Orchha, District Narayanpur. 2.

The contention of the petitioner is that so far as the petitioner is concerned, he is being sent from scheduled area to a core scheduled area and that there is already a threat to his life as is evident from the correspondence made by the Superintendent of Police, Narayanpur to the Collector, Narayanpur vide Annexure P/4 dated 19.08.2019. The threat is on the ground that a few of the relatives of the petitioner are working in the Armed

-2Force in the State Government and they are all posted in the naxalite area and they all stay at the resident of the petitioner and now if the petitioner is sent to a hard core area, there is all possibility of the petitioner becoming a threat to the naxalite attack.

3.

Considering the aforesaid facts and circumstances of the case, let the petitioner make a detailed representation to the respondent within a period of 10 days from the date of receipt of the copy of this order and the respondents in turn shall consider and decide the same within a further period of 45 days from the date of receipt of the representation. Till the representation of the petitioner is decided, the effect and operation of the impugned order shall remain stayed.

4.

With the aforesaid observations, the present writ petition stands disposed off.
