Mr. Shobhit Koshta, Advocate For State :

Ms. Sunita Jain, Govt. Advocate Hon'ble Shri Justice P. Sam Koshy Order on Board 30.08.2019

1. The challenge in the present Writ Petition is to the order Annexure P2 dated 22.08.2019, whereby the petitioner has been transferred from Block- Koilibedha, Kanker, District: Uttar Baster, C.G. to

-2Government High School, Kadhme, Block: Koilebedha, District: Uttar Baster, Kanker, (C.G.)

2. The contention of the petitioner is that, it is recently that the petitioner has been posted at the present place as is evident from Annexure P-1 dated 21.12.2018. In less than about 8 months time, the petitioner has again been shifted from the present place of posting, the same appears to be contravention to the transfer policy of the State Government itself, which says/shows that normally a person should not be transferred unless he completes one year at one place.

3. Let the petitioner make a detailed representation to the authorities concerned within 10 days from the date of copy of this Order and the respondent authorities may consider and decide the same within a further period of 45 days from the date of receipt of representation of the petitioner.

4. Till the representation of the petitioner is decided, there shall be stay of the effect and operation of the impugned order, so far as the petitioner is concerned.

5. With the aforesaid observations, the present Writ Petition stands disposed off.
