Challenge in the present writ petition is to the order of transfer dated 23.8.2019 whereby the petitioner has been transferred from the Office of Assistant Director, Horticulture, Mungeli, District Mungeli to the Office of Assistant Director, Horticulture, Balrampur, District Balrampur.

Counsel for the petitioner submits that the petitioner is a probationer in service as he was appointed only on 7.9.2018 and the probation period is of two years. He further submits that the regulation of the State Government itself holds that the probationer should not be transferred during the probation period. 3.

Given the aforesaid fact, let the petitioner within 10 days from today make an appropriate representation to respondent no.2 who in turn shall consider and decide the same within a period of 45 days from the date of receipt of representation. 4.

Till the representation is decided, the effect and operation of the impugned order shall remain stayed so far as the petitioner is concerned. 5.
