1. Heard.

2. This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 13.10.2021 in connection with Crime No. 507/2021 registered at Police Station Urga, District Korba (CG) for the offence punishable under Section 509 (B) of the Indian Penal Code and Section 15 of the Protection of Children from Sexual Offences Act, 2012.

3. As per the prosecution case, on 12.10.2021 nude photographs of the daughter of the complainant was found in the mobile of the applicant and it was made

public. Thereby the offence has been committed.

4. Learned counsel for the applicant submits that the applicant and the victim were studying in the same college and the applicant is also student of 19 years and no other investigation would be required in this matter as the seizure has already been made, therefore, the applicant may be released on bail.

5. Per contra, learned State counsel opposes the prayer for grant of bail.

6. The father of the victim Madhusudan Dewangan and her daughter/victim are present in person before the Court and they also objected to the bail and would submit that the applicant may not be enlarged on bail.

7. Perused the statement of the victim. The victim and the applicant were studying in the same school. The applicant is aged about 19 years and he is in jail since 13.10.2021 and the seizure has already been made, therefore, no further investigation would be required. Considering the same, I am inclined to release the applicant on bail.

8. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court.
