1. The applicant has preferred this first bail application under Section 439 of Cr.P.C. as he is in jail since 5-9-2020 in connection with Crime No. 95 of 2020 registered in Police Station- Lundra, District Surguja (CG) for the offence punishable under Section 376(2)(n) of IPC.

2. Learned counsel for the applicant seeks permission of this court to withdraw this bail application with liberty to file afresh as and when occasion arises.

3. Permission is granted.

4. Accordingly, the instant bail application is dismissed as withdrawn with the aforesaid liberty.
