The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.45/2011 registered in Police Station Pakhanjur District North Bastar Kanker (C.G.) for offence punishable under sections 420, 409 and 34 of Indian Penal Code. 2.

As per the prosecution case, the applicant and other co-accused who were working as agents for sale of tractor assured the complainant that instead of old tractor, they may get a new tractor for him and as such the old tractor which was in possession of the complainant Shivlal Dehari was acquired and was sold to one Mangal Ghosh for Rs.90,000/- but this fact was not disclosed as such the applicant committed fraud. 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case. He submits that similarly placed co-accused have been enlarged on bail by this court in M.Cr.C.No.4126/2016 on 27/07/2016 and case of the applicant is also similar, therefore the applicant may be released on bail. 4.

Learned State counsel do not dispute the fact that similarly placed co-accused have been enlarged on bail in M.Cr.C.No.4126/2016 on

27/07/2016.

Considering the facts and circumstances of the case and also for the fact that similarly placed co-accused have been enlarged on bail in M.Cr.C.No.4126/2016 on 27/07/2016, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
