1. The challenge in the present Writ Petition is to the order AnnexureP/1 dated 22/08/2019 whereby the services of the petitioner has been transferred from office of the Deputy Director, Horticulture, Raipur to office of the Assistant Director, Horticulture, Kabirdham.

2. Counsel for the petitioner submits that the petitioner has a sister, who is mentally retarded and completely dependent upon the petitioner who has to take care of her alone. Therefore, in case if the order of transfer is complied with, it would be much difficult for petitioner in managing his sister.

3. Given the aforesaid facts, let the Petitioner makes a detailed representation to the respondents in this regard within a period of 10 days from the date of receipt of copy of this order and respondents

in turn shall take a decision sympathetically within further period of 45 days from the date of receipt of representation of the petitioner.

4. Till the decision is decided, there shall be a stay of effect and operation of the order so far as the petitioner is concerned.

5. While considering the case of the petitioner, the respondents are expected to take a decision on sympathetic view.
