2. Learned counsel for the applicant submits that he be permitted to withdraw the instant MCRCA with liberty to file afresh a duly constituted MCRCA. He further prays that certified copy of the order passed by the Court of Sessions, Janjgir Champa, CG may also be returned to him.

3. As prayed, instant MCRCA is disposed of as withdrawn without any appreciation on its merit with the liberty as prayed for.

4. Registry is directed to return the certified copy of the impugned order after retaining the authenticated true copy of the same in the matter.

5. MCRCA is disposed of as withdrawn.
