Hon'ble Shri Justice Gautam Chourdiya Order on Board 17/12/2021 1) This criminal revision is filed under Section 397/401 of Code of Criminal Procedure, 1973 challenging the order dated 02.09.2021 passed by learned Special Judge (Atrocities Act) Raipur, District Raipur (C.G.) in S.T. No. 150/2020 rejecting the application of the applicant under Section 311 of Cr.P.C. for recalling of the prosecutrix.

2) Learned counsel for the petitioner seeks to withdraw the instant revision petition as she wants to file a duly constituted petition under Section 482 of Cr.P.C.. However, she prays for return of certified copy of the impugned order.

3) Counsel for the State has no objection to the above prayer. 4) Permission granted.

5) Accordingly, the revision petition is dismissed as withdrawn. 6) Registry is directed to return the certified copy of the impugned order to the counsel for the petitioner after retaining a photocopy of the same.
