1. The challenge in the present writ petition is to the order of transfer dated 23.08.2019 Annexure P-4 whereby the petitioner has been transferred from Employees State Insurance Service Centre

Baikunth, District Raipur to Employees State Insurance Service Centre, Patarapali, District Raigarh.

2. The contention of the petitioner is that the wife of the petitioner is also working as Shiksha Karmi and on her own request, forgoing her seniority, the wife was transferred to Tilda i.e. the place where the petitioner is working. Now vide impugned order, the petitioner has been shifted to an entirely different place which is thus violation of the transfer policy of keeping husband and wife as far as possible at the same place. Further contention of the petitioner is that the previous order of transfer itself had been stayed by this Court in WPS No. 4544 of 2017 where there is an interim protection still in operation in favour of the petitioner.

3. Given the aforesaid facts, let the petitioner make a detailed representation to the respondents within a period of 10 days from the date of receipt of certified copy of this order and the respondents in turn shall consider the same within a period of 45 days from the date of receipt of the representation.

4. Till the representation of the petitioner is decided, the effect and operation of the impugned order so far as the petitioner is concerned shall remain stayed
