1. The applicant has preferred this second bail application under Section 439 of Cr.P.C. as he is in jail since 09.10.2020 in connection with Crime No. 122/2020 registered in Police Station- Darima, District Surguja (CG) for the offence punishable under Sections 302/34 & 120B of IPC.
2. The first bail application of the applicant was dismissed as withdrawn, however liberty was granted to applicant to file afresh as and when occasion arises vide common order dated 15.07.2021 passed in M.Cr.Cs. No. 1126; 1662 & 3908 of 2021.
3. Learned counsel for the applicant seeks to withdraw this bail application, however, he prays for a direction to the trial Court to expedite the trial.
4. Accordingly, the second bail application is dismissed as withdrawn. However, looking to the period of custody of the applicant, the trial Court is directed to expedite the trial and conclude the same as early as possible. Sd/- (Gautam Chourdiya) Judge vatti
