For the reasons assigned therein and also for the fact that the Non-applicant who has entered his appearance does not oppose the I.A. No.1, the same is allowed and the delay of 25 days occurred in the filing of the present petition is condoned.

Also heard on application for grant of leave to appeal.

Taking into consideration the reasons assigned therein and also on perusal of the record, this Court is of the opinion that a strong case has been made out for grant of leave to appeal.

Accordingly, the application for grant of leave to appeal is allowed.

Registry is directed to register the present case as a regular Acquittal Appeal.

Since the Non-applicant has already entered his appearance, no fresh notice is required to be made. Heard on Acquittal Appeal.
