Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 06/01/2021

1. This is the second bail application preferred by the applicant under Section 439 of Cr.P.C. for grant of bail, as he is arrested in connection with Crime No.10/19, registered at Police Station - Chhote Bathiya, District- U.B. Kanker (C.G.) for the offences punishable under Sections 363 and 376 (3) of Indian Penal Code and 4 of the Protection of Children from Sexual Offence Act, 2012.

2. The earlier bail application was dismissed with liberty to revive the prayer after examination of the prosecutrix.

3. As a matter of fact, prosecutrix was already examined on 18-03-2020 much before the rejection of the first bail

application by this Court.

4. Having seen the statement of the prosecutrix vide Annexure A-2, I am not inclined to take any different view of the matter.
