The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.187/2016 registered in Police Station Bilagarh, Revenue & Civil District-Baloda-Bazar-Bhatapara, C.G. for offence punishable under section 306 of IPC. 2.
As per the prosecution case, one Sanju Sarthi committed suicide by hanging on 18/05/2016. When the matter was investigated further it revealed that the applicant has committed sexual assault on the deceased and therefore she committed suicide.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case. He submits that only allegation against this applicant that he tried to outrage modesty of the deceased and thereby she committed suicide and it cannot be stated that applicant has abetted commission of crime, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Perused the statement of mother Neera Bai wherein it is stated that before her death while she was weeping, on being asked she disclosed
that she was subjected to sexual assault by the applicant and thereafter committed suicide. Considering the facts and circumstances of the case, this court is not inclined to release the applicant on bail. 6.
