1. The applicant has preferred this bail application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.192/2021 registered in Police Station Patthalgaon, District Jashpur C.G. for the offence punishable under Sections 408, 212, 34 of the I.P.C.

2. Case of the prosecution, in brief, is that on 03.9.2021, complainant Arun Kumar Gupta lodged the written report alleging that he gave Rs.9,50,000/- cash amount to the applicant for depositing the said amount in bank but the applicant has not deposited the amount and also switched off his phone. When complainant searched the applicant he was not found in his house after which the complainant

MCRC No. 8709 of 2021 lodged the FIR.

3. Learned counsel for the applicant submits that the applicant has been falsely implicated and he is in jail since 06.9.2021. He would further submit that co-accused has been released on bail and the applicant is a permanent resident of Chhattisgarh State, therefore, he may be released on bail.

4. Per contra, learned State counsel would oppose the prayer for grant of bail.

5. Considering the facts and circumstances of the case as also for the fact that applicant is in detention since 06.9.2021; the applicant is a servant of the complainant and the offence is triable by JMFC, this Court is inclined to release the applicant on bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
