1. Heard.

2. We find that during the pendency of present appeal which arises out of the order of restitution of conjugal rights between the husband and wife, a decree of divorce has been granted by the trial Court in favour of respondent including grant of visitation rights also.

3. In that view of the matter, the present appeal is rendered infructuous and is accordingly disposed off.

4. Disposal of this appeal shall not come in the way of either of the parties in challenging the impugned judgment and decree of divorce or claiming visitation rights or custody of the child.
