Hon'ble Shri Justice P. Sam Koshy Order on Board 25/01/2021 All these cases have been filed by the petitioners seeking for a relief against the respondents to ensure providing employment to the petitioners.
The contention of the petitioners is that their agriculture land has been acquired by the respondents and though they have granted suitable compensation for the same, but they have been denied employment by the respondents.
At the outset, this Court is of the opinion that the claim of the petitioners would not be sustainable for the reason that the acquisition have been admittedly made for the purpose of construction and widening of road. The acquisition was not for any industrial purpose or for establishment of any factory or an industry, nor was it for any mining activities, where the beneficiary establishment for whom the property was acquired could be asked
to provide employment to the land losers. In the instant case, the acquisition has been made for the purpose of construction of road and therefore on the completion of the construction of road, there is no possibility for the respondents to provide employment to the land losers and this fact also has been taken note of in the course of calculating the compensation and which have been admittedly paid to each of the petitioners.
Under the circumstances, this Court is of the opinion that no such relief as sought for by the petitioners can be granted at this juncture. The writ petitions accordingly are not sustainable and stand rejected.
